The federal Labor government is starting NDIS cuts from 1 July. What will the Minns Labor government do to ensure people with disability in NSW don't fall through the gaps?

Today in Parliament, Abigail condemned the federal Labor government's sweeping NDIS cuts and called on the NSW Labor government to fight them. With reductions to social and community participation funding starting as early as 1 July 2026 and replacement services not ready, people with disability will fall through the gaps unless governments act now.

Abigail said:

I give notice that on the next sitting day I will move: 

(1) That this House notes that:

  • in recent months, the major parties have been peddling ableist rhetoric about disability supports, treating people with disability as a political football and demonising some of the most vulnerable people in our society and their fundamental right to essential, daily supports;
  • before the NDIS was created, disability supports were largely run by state and territory governments; however because they were so inadequately resourced the provision of these services was categorised by fragmentation, scarcity and segregation, with access to services heavily dependent on a person’s location and type of disability; 
  • the sweeping cuts to the NDIS announced by the federal Labor government in April 2026 will put the responsibility back on state and territory governments to fund, design and deliver a significant portion of disability supports, with reductions in social and community participation funding beginning as early as 1 July 2026; 
  • the 2011 Productivity Commission report that ultimately led to the creation of the NDIS found the previous state systems were “underfunded, unfair, fragmented, and inefficient”, with many people with disability ending up living permanently in institutions where abuse, neglect and exploitation was rife; 
  • state and territory governments have already warned they do not have capacity to replace what is being cut by the federal government, and that new state services may not be ready in time; and 
  • cutting people off from accessing supports that guarantee social and community participation before new services are developed and ready to be delivered will undeniably lead to people falling through the gaps, creating a real risk of exclusion, neglect and exploitation. 

(2) That this House acknowledges that in accordance with Article 19 of the UNCRPD, all governments have the responsibility to:

  • recognise the equal right of all people with disability to live in the community, with choices equal to others;
  • take effective and appropriate measures to facilitate full enjoyment of this right and the full inclusion and participation of people with disability in the community; 
  • ensure that people with disability have access to a range of in-home, residential and other community support services, including personal assistance necessary to support living and inclusion in the community, and to prevent isolation or segregation from the community; and
  • ensure that community services and facilities for the general population are available on an equal basis to persons with disabilities and are responsive to their needs. 

(3) That this House calls on the NSW government to:

  • advocate to the federal Labor government to urgently reverse its cruel cuts to the NDIS and instead engage with the disability community to implement other systemic reforms that will rein in costs and address the issues with the NDIS without cutting off those in need; and 
  • assure the disability community that it will make sure that no one falls through the gaps in disability service provision by making a commitment to provide significant and ongoing funding in the 2026-27 NSW Budget for adequate, accessible, efficient and equitable services that are individually-tailored, self-directed and age-appropriate for all people with disability in our state.
